EDISON V. STATE CASE NO.: 2D05-2808

Appellate Background: An appeal to the Second District Court of Appeal from a jury conviction and corresponding sentence of 10 years in state prison for trafficking in cocaine.

Appellate Result: Case reversed. As a result of our firm’s appellate brief, the Second District Court of Appeal overturned the circuit court jury conviction and 10 year state prison term.

Mr. Edison is a free man without prison, house arrest or probation.

ESLER V. STATE CASE NO.: 2D04-1097

Appellate Background: An appeal to the Second District Court of Appeal from a jury conviction and sentence of 5 years in prison on a count of DUI with serious bodily injury.

Appellate Result: Case reversed. As a result of our firm’s appellate brief, the Second District Court of Appeal overturned the circuit court jury conviction and 5 year state prison term.

Ms. Esler is a free woman without prison, house arrest or probation.

HENDRICKSON V. STATE CASE NO.: 2D02-1304

Appellate Background: An appeal to the Second District Court of Appeal from a jury conviction and corresponding sentence of 15 years in state prison on one count of trafficking in methamphetamine and one count of possession with the intent to deliver methamphetamine.

Appellate Result: Case reversed. As a result of our firm’s appellate brief, the Second District Court of Appeal overturned circuit court jury conviction and the corresponding 15 year state prison term.

ROBINSON V. STATE CASE NO.: 2D03-2460

Appellate Background: An appeal to the Second District Court of Appeal from a jury conviction and corresponding sentence of 15 years in state prison followed by 2 years of community control and 13 years of sex offender probation on one count of lewd and lascivious molestation and on count of sexual battery.

Appellate Result: Case reversed. As a result of our firm’s appellate brief, the Second District Court of Appeal overturned circuit court jury conviction for lewd and lascivious molestation and the corresponding 15 year state prison term and corresponding 2 year community control and 13 years sex offender probation sentence.

STATE V. HOMANS CASE NO.: 03-CF-2585

Appellate Background: A 3.850 post conviction motion to the Thirteenth Judicial Circuit Court from a guilty plea and corresponding conviction and sentence of 5 years in state prison and 10 years of sex offender probation.

Appellate Result: Case Reversed. As a result of our firm’s legal efforts, Thirteenth Judicial Circuit Judge Anthony K. Black terminated Mr. Homan’s 10 year sexual offender probation term and discharged the 5 year state prison term.

Mr. Homans is a free man without prison, house arrest, probation or a sexual offender designation.

STATE V. DIAZ CASE NO.: 04-CF-8349

Appellate Background: A motion to the Thirteenth Judicial Circuit Court to re-hear and reconsider a sentence of 5 years in state prison resulting from a guilty plea and corresponding conviction resulting from the advice of a lawyer unrelated to O’Brien Bower, PA.

Appellate Result: Case Reversed. As a result of our firm’s legal efforts, Thirteenth Judicial Circuit Judge Daniel L. Perry immediately released Mr. Diaz from his 5 year state prison term.

Mr. Diaz is a free man without prison, house arrest or probation.

STATE V. WILLAMS CASE NO.: 90-CF-7926, 94-CF-4370

Appellate Background: A motion to the Thirteenth Judicial Circuit to re-hear and reconsider a sentence of 12 years in state prison resulting from a guilty plea and corresponding conviction resulting from the advice of a lawyer unrelated to the law firm of O’Brien Bower, PA.

Appellate Result: Case Reversed. As a result of our firm’s legal efforts, Thirteenth Judicial Circuit Judge Chet A. Tharpe reinstated Mr. Williams’s original term of probation and immediately released him from his 12 year state prison term.

Mr. Williams is a free man without prison, probation or house arrest.
